2. PURPOSE
These Terms and Conditions (hereinafter "Terms") govern the use of the PyNav mobile application (hereinafter "the Application").
PyNav is a marine application providing:
- Professional NMEA data display on tablet (navigation center)
- Remote control of the pypilot open-source autopilot system (optional)
The Application can be used independently of pypilot as a standalone NMEA navigation center. It provides:
- Free version: Access to the pypilot control tab only (current heading, modes, gains, emergency stop). No external NMEA data. Requires a pypilot installation.
- PRO version (launch price: €8.99, regular price: €12.99): Complete NMEA navigation center on 10"+ tablet. Usable WITH or WITHOUT pypilot. Only requires a NMEA/WiFi module and a tablet (4 GB RAM minimum).
By downloading and using the Application, the user accepts these Terms without reservation.
3. DEFINITIONS
- Application: Refers to the PyNav software available on the Google Play Store
- User: Any person using the Application
- Pypilot: Open-source autopilot system developed by Sean D'Epagnier
- NMEA: Standard communication protocol for marine equipment (NMEA 0183 and NMEA 2000)
- Free version: Pypilot remote control features accessible without payment
- PRO version: Advanced NMEA display features requiring a one-time purchase
4. TECHNICAL REQUIREMENTS
Use of the Application strictly requires:
4.1 Required Hardware
- An Android smartphone or tablet (version 7.0 minimum recommended)
- A functional and properly configured pypilot installation (Raspberry Pi + motor + sensors)
- A WiFi network allowing communication with the pypilot server
4.2 Required Skills
The User must:
- Possess the necessary knowledge to install, configure, and use pypilot
- Know maritime navigation rules (COLREG)
- Be capable of maintaining their pypilot installation
- Be able to interpret NMEA navigation data
5. NATURE OF THE SERVICE
5.1 What the Application IS
The Application is:
- A control interface allowing commands to be sent to an existing pypilot system
- A reader and display of NMEA data from navigation equipment
- An accessory software facilitating the use of pypilot
- A complementary tool to regulatory navigation equipment
5.2 What the Application IS NOT
The Application IS NOT:
- An autonomous autopilot system
- Certified or approved navigation equipment
- A substitute for regulatory navigation equipment
- A guarantee of pypilot's proper functioning
- A replacement for the navigator's human judgment
5.3 Important Clarifications
Pypilot:
- Is an independent open-source project developed by Sean D'Epagnier
- Is provided "as-is" without any warranty (GPLv3 license)
- Is not a certified commercial product for maritime navigation
- Is the sole responsibility of its creator and the open-source community
The publisher of PyNav:
- Has no affiliation with the pypilot developer
- Does not manufacture or sell autopilot systems
- Does not guarantee pypilot's operation
- Only provides a software control interface
6. FEATURES
6.1 FREE Version
The free version includes:
- TCP/IP connection to pypilot server
- Complete autopilot remote control
- Heading modification
- Piloting mode change (compass, GPS, wind, nav)
- Pypilot gain and parameter settings
6.2 PRO Version (€8.99 - One-time purchase)
The PRO version additionally unlocks:
- Advanced NMEA 0183 and NMEA 2000 data display
- Customizable navigation instruments (compass, speedometer, depth sounder, anemometer, etc.)
- Real-time graphs (speed, heading, wind, depth, etc.)
- Navigation histories and trends
- Multiple customizable dashboards
- Custom alerts (wind, depth)
- Free lifetime updates
7. USER RESPONSIBILITY
7.1 Navigation and Safety
The User acknowledges and accepts that:
The skipper remains solely responsible for:
- Navigation and the safety of the vessel and its occupants
- Permanent watch at sea (regulatory obligation)
- Interpretation of navigation data
- Making all navigation decisions
- Compliance with international maritime rules (COLREG)
The Application does NOT relieve the obligation to:
- Maintain permanent visual and radar watch
- Have regulatory navigation equipment
- Consult official and up-to-date nautical charts
- Verify navigation data by other means
- Exercise good maritime judgment
7.2 Installation and Maintenance
The User commits to:
- Properly install and configure their pypilot system
- Regularly verify the proper functioning of their installation
- Maintain their equipment in good working order
- Not use the Application if pypilot shows malfunctions
- Test the Application under safe conditions before navigational use
- Always have backup manual steering means
7.3 Appropriate Use
The User commits to:
- Not use the Application in dangerous conditions (storm, difficult navigation, etc.)
- Not rely solely on the Application for navigation
- Verify commands sent to the autopilot
- Constantly monitor the vessel's behavior
- Immediately stop use in case of anomaly
- Not use the Application if navigation skills are insufficient
8. LIABILITY LIMITATION
8.1 Disclaimer of Warranty
The Application is provided "AS IS" and "AS AVAILABLE" without any warranty, express or implied, including:
- No guarantee of uninterrupted or error-free operation
- No guarantee of displayed data accuracy
- No guarantee of compatibility with all pypilot configurations
- No guarantee of permanent service availability
8.2 Pypilot Liability
The publisher cannot be held responsible for:
- Failures, bugs, or malfunctions of pypilot itself
- Incorrect or defective pypilot installation
- Inappropriate pypilot system configuration
- Intrinsic limitations of pypilot as a DIY open-source project
- Pypilot's design decisions or technical choices
8.3 Navigation Incident Liability
The publisher disclaims all liability in case of:
- Maritime accidents: collision, grounding, capsizing, sinking
- Material damage: vessel damage, equipment damage, transported goods damage
- Bodily harm: injuries, trauma, death
- Environmental damage: pollution, ecosystem destruction
- Financial losses: towing costs, repair costs, loss of operation
- Data loss: routes, waypoints, navigation parameters
8.4 Technical Liability
The publisher cannot be held responsible for:
- Command transmission errors (due to WiFi network, interference, etc.)
- Incompatibility with certain pypilot versions or configurations
- Application software bugs
- Service interruptions (maintenance, update, server failure)
- Network connection loss between Application and pypilot
- NMEA data display errors
- Command transmission latency
8.5 Force Majeure
The publisher cannot be held responsible in case of force majeure or events beyond its control: Internet outage, power failure, natural disaster, war, hacking, etc.
8.6 Liability Cap
In any event, the publisher's liability, if it were to be held, would be limited to the amount paid by the User for the Application (maximum €8.99 for PRO version, €0 for free version).
9. COMPATIBILITY
9.1 Supported Pypilot Versions
The Application is compatible with:
- Pypilot version 0.x and later
- Standard pypilot communication protocol (TCP/IP)
9.2 Supported NMEA Sources
The Application can read NMEA data from:
- The pypilot server itself
- Any NMEA 0183 source connected to the network
- Any NMEA 2000 source via NMEA gateway
9.3 No Compatibility Guarantee
The publisher does not guarantee:
- Compatibility with all custom pypilot configurations
- Compatibility with future pypilot versions
- Compatibility with all NMEA peripherals
- Operation on all Android device models
10. LICENSE OF USE
10.1 Non-Exclusive License
The publisher grants the User a non-exclusive, non-transferable, and revocable license to use the Application.
10.2 Restrictions
The User is prohibited from:
- Copying, modifying, adapting, translating, or creating derivative works of the Application
- Decompiling, disassembling, or attempting to extract source code
- Renting, lending, selling, sublicensing, or distributing the Application
- Using the Application for commercial purposes without authorization
- Circumventing protection or in-app purchase mechanisms
- Using the Application fraudulently or illegally
10.3 Intellectual Property
The Application and all its elements (code, design, graphics, texts, etc.) are protected by copyright and remain the exclusive property of CL Consulting SASU.
Important note: Pypilot is a separate project under GPLv3 license, property of its author Sean D'Epagnier and the open-source community.
11. PRO VERSION - PURCHASE CONDITIONS
11.1 Price and Payment
- Price: €8.99 including VAT (one-time purchase)
- Payment: Via Google Play (Android) or Apple App Store (iOS) (credit card, Google Pay, etc.)
- Currency: Price displayed in User's country currency
11.2 No Refund
In accordance with Google Play policy, no refund is possible after PRO version activation, except in case of hidden defect or manifest non-conformity.
Users are invited to test the free version before purchasing the PRO version.
11.3 Permanent Purchase
PRO version purchase is permanent and lifetime:
- No monthly or annual subscription
- No hidden or recurring fees
- Free lifetime updates included
- Usable on all Android devices associated with User's Google account
11.4 Purchase Restoration
If the User uninstalls then reinstalls the Application, the PRO version will be automatically restored at no additional cost (same Google account).
11 bis. PRICING POLICY AND LAUNCH OFFER
Launch Price
As part of PyNav's launch, the publisher offers a temporary launch offer:
- Launch price: €8.99 - valid for the first 3 months following the Application's publication date on the stores
- Regular price: €12.99 - applicable after the launch period ends
Guarantees for Launch Price Buyers
Users who purchased the PRO version at the launch price of €8.99 benefit from the following guarantees:
- ✅ Lifetime access to all PRO features
- ✅ All future free updates included
- ✅ No additional charges when regular price takes effect
- ✅ Same rights as regular price buyers
Pricing Transparency
The publisher commits to:
- Clearly communicating the end date of the launch price
- Never charging launch price buyers again
- Maintaining a stable regular price after the launch period
12. PERSONAL DATA AND PRIVACY
12.1 Collected Data
The Application transmits NO navigation data to the publisher.
The only data collected are:
- Local network connection: Local IP address of pypilot server (stays on local network)
- Purchase identifier: Google Play token to verify PRO version purchase (managed by Google)
- Crashlytics (optional): Anonymous error reports to improve Application stability
12.2 No Sensitive Data Transmission
The Application does NOT transmit to the publisher:
- GPS positions
- Routes and waypoints
- NMEA data
- Pypilot parameters
- User preferences (stored locally only)
12.3 GDPR Compliance
The publisher complies with the General Data Protection Regulation (GDPR).

13. SAFETY WARNINGS
13.1 Main Warning

CRITICAL SAFETY WARNING
PyNav and pypilot are navigation AID tools, NOT substitutes for human judgment.
- The skipper remains SOLELY RESPONSIBLE for navigation
- Permanent watch is MANDATORY at sea (international regulation)
- Pypilot is a DIY open-source project WITHOUT maritime certification
- The Application may have bugs, errors, or malfunctions
- NEVER blindly trust an autopilot
13.2 Dangerous Situations
DO NOT use the Application in the following situations:
- Difficult weather conditions (storm, heavy swell, dense fog)
- Navigation in congested areas (ports, channels, fishing zones)
- Proximity to dangers (rocks, shoals, wrecks)
- Dense maritime traffic or crossing routes
- In case of pypilot malfunction
- If you lack necessary navigation skills
- If you are tired, under influence of alcohol or judgment-altering substances
13.3 Backup Equipment
You must ALWAYS have:
- Backup manual steering means (tiller, emergency rudder)
- Up-to-date paper nautical charts
- Magnetic bearing compass
- Emergency communication means (VHF, satellite phone)
- Independent backup GPS
13.4 Prior Testing
Before any use in actual navigation:
- Test the Application in port or at anchor
- Verify WiFi connection reliability
- Ensure pypilot responds correctly to commands
- Familiarize yourself with interface and features
- Test the emergency stop button
14. UPDATES
14.1 Application Updates
The publisher may release Application updates to:
- Fix bugs
- Improve performance
- Add new features
- Ensure compatibility with new Android or pypilot versions
14.2 Free Updates
All updates are free for:
- Free version users
- PRO version buyers (lifetime updates)
14.3 Update Installation
Updates are distributed via Google Play Store. The User is responsible for keeping the Application up to date.
15. TERMINATION
15.1 By the User
The User may stop using the Application at any time by uninstalling it.
Warning: Uninstalling does NOT entitle a refund of the PRO version.
15.2 By the Publisher
The publisher reserves the right to suspend or terminate Application access in case of:
- Violation of these Terms
- Fraudulent or illegal use
- Abusive or harmful behavior
15.3 Application Discontinuation
The publisher reserves the right to permanently discontinue the Application with reasonable notice. No refund will be due in this case.
16. APPLICABLE LAW AND JURISDICTION
16.1 Applicable Law
These Terms are governed by French law.
16.2 Competent Jurisdiction
In case of dispute, and failing amicable resolution, French courts shall have sole jurisdiction.
The competent court will be that of CL Consulting SASU's registered office (Propriano, France) or the consumer's domicile.
17. TERMS MODIFICATIONS
The publisher reserves the right to modify these Terms at any time.
Users will be informed of modifications via:
- A notification in the Application
- A message on Google Play Store
Continued use of the Application after Terms modification constitutes acceptance of new conditions.
